Terms of service

These terms govern the relationship between The Sun Collective® and anyone booking one of our experiences, whether directly on our website or with the help of our team.

Sections 1 to 14 apply to every booking. Section 15 sets out the additional terms for bookings that include accommodation, which the law calls package travel. If your booking doesn't include accommodation, that last section doesn't apply to you.

By booking you accept these terms. If anything isn't clear, write to us at admin@thesuncollective.art before you book and we'll explain it.


Definitions

Product page. The page on our website where we describe each experience, including what it covers, dates, locations, duration and price.

Booking. The contracting of an experience through any of the routes in section 3.

Confirmation. The email you receive once your booking is closed. It sets out what you've booked and the applicable terms.

Total price. The final amount you pay, with all taxes included.

Booking with accommodation. One where accommodation forms part of what you've booked. It is package travel and section 15 also applies.

Outdoor activity. One that takes place outside, in the landscape or in heritage spaces, accompanied by our team. It is registered as active tourism.

Supplier. Any company other than ours that provides a service we've arranged for you.


1. Who we are and who you're contracting with

1.1. You're contracting with Brisa Digital SL, a Spanish single-member limited company, NIF B75637975, with its registered office at Calle Los Dragos 4, Puerta 86, Costa Teguise, 35508 Teguise, Las Palmas. It trades under the brand The Sun Collective®.

1.2. We're registered with the Canary Islands tourism registry as a travel agency, under code I-AV-0005016.1, and as an active tourism company, under reference TA-3-70-ES-0000007.A3.01.01.

1.3. You can write to us at admin@thesuncollective.art or reach us on +34 682 142 118, also by WhatsApp.

1.4. To book you must be of legal age and have capacity to contract.

1.5. If you book for other people, you agree to pass this information on to them and you're responsible to us for all of them complying with these terms.


2. What you can book

2.1. The product page and your confirmation

2.1.1. On each product page we describe what the experience includes and what it doesn't, the dates, the location, the duration and the total price.

2.1.2. What we tell you on the product page about the experience is what we commit to providing with your booking.

2.1.3. The document that records what you've booked is your confirmation. It sets out the details of your booking and the applicable terms, dated, in a format you can keep and consult whenever you want.

2.1.4. Please check your confirmation when it arrives. If anything doesn't match what you expected, tell us within the following 72 hours and we'll correct it, or you can cancel at no cost.

2.1.5. Any changes we make to our website afterwards don't affect bookings already made.

2.1.6. Some experiences have their own terms, which we set out on the product page and in your confirmation. Where those terms differ from this document, the product page prevails, as it holds the terms specific to what you've booked.

2.1.7. That has one limit. The terms on a product page can never give you fewer rights than the law gives you, and those always apply.

2.2. Bookings with accommodation

2.2.1. When accommodation forms part of what you've booked, your booking is package travel and we act as the organiser.

2.2.2. That gives you additional rights, including that we're responsible for the proper provision of every service included even when another company provides it, that your payments are protected, that you can transfer your booking to someone else, and that you can recover everything you've paid if we make a significant change or cancel.

2.2.3. These rights are set out in full in section 15.

2.3. Outdoor activities

2.3.1. These activities are registered as active tourism, which brings requirements on safety, insurance and the qualifications of the team leading them.

2.3.2. On the product page we publish the route and locations, the estimated duration, the level of difficulty, the physical condition required, the minimum age, the materials we provide and those you need to bring, and the safety and emergency protocol.

2.3.3. Where the activity includes transport from the meeting point, that transport is part of the total price. We don't invoice it separately or sell it on its own.

2.4. Workshops and sessions

2.4.1. These take place indoors, without going out into the natural environment and without an overnight stay.

2.4.2. They're not subject to tourism registration and are governed by these terms and by their product page.

2.5. Services provided by other companies

2.5.1. Sometimes we arrange access to services provided by another company, such as a dinner, a transfer or a cultural activity.

2.5.2. We identify the supplier to you before you book. The contract for that service is between that company and you, is governed by their terms, and we're not responsible for how it's carried out.

2.5.3. This doesn't apply when a supplier's service is included within a booking with accommodation. In that case it forms part of the package and we're responsible for it under section 15.


3. How to book

3.1. How our process works

3.1.1. We never charge automatically. When you complete a booking you authorise a payment, but nothing is charged at that point.

3.1.2. We then review your booking and talk to you by email, phone, chat or WhatsApp, to make sure the dates, the options and the price are the ones you want.

3.1.3. Only then do we take the payment and send you your confirmation. That email is what closes the contract between us.

3.1.4. We usually confirm within a maximum of 48 hours.

3.1.5. If we can't confirm your booking, for example because the group is already full, we'll tell you, release the authorisation and charge you nothing.

3.1.6. Before you authorise the payment you have available all the information about the experience, the amount being authorised and these terms. If anything comes up at that point, write to us and we'll clear it up before you book.

3.1.7. The button that completes the order states expressly that it carries an obligation to pay.

3.2. What amount is authorised

3.2.1. The amount you authorise depends on the experience and on when you book. The product page always tells you before you confirm.

3.2.2. For workshops and day activities we usually authorise the total price of the experience, unless the product page states a different amount.

3.2.3. For bookings with accommodation, we usually authorise 100 euros, because the final price depends on the options you choose. When the start date is close and the price is already settled, the total price may be authorised instead.

3.2.4. Those 100 euros form part of the final price and aren't added on top of it.

3.3. The starting price for bookings with accommodation

3.3.1. For these bookings the final price depends mainly on the type of accommodation and the occupancy. That's why the product page shows a starting price, which corresponds to the most affordable option genuinely available, usually a shared double room.

3.3.2. After your request we talk to you to settle the options and the total price.

3.3.3. Your booking is confirmed, and the payment taken, only once you've accepted that total price.

3.3.4. If you decide not to go ahead, we release the authorisation and charge you nothing.

3.4. Bookings prepared by our team

3.4.1. You can also book with the help of someone on our team, by email or WhatsApp. In that case we prepare the booking for you and send you all the applicable information before you make the payment.

3.4.2. We hold the place for 72 hours from the moment we send you the booking.

3.4.3. After that time, if we haven't received payment, the place goes back on sale.

3.4.4. If you let us know a bank transfer is on its way, we'll hold the place until the payment arrives. International transfers can take several days and we don't want you to lose your place because of that.

3.4.5. Every booking, whether direct or prepared by our team, is registered on our platform and receives the same documentation.

3.5. Your confirmation

3.5.1. With your confirmation we send you by email the details of what you've booked and the applicable terms. Please keep it.

3.5.2. Before the experience begins we send you the practical information, with the meeting point, timings and a contact number for those days.


4. Prices and payments

4.1. Prices and taxes

4.1.1. All prices are in euros and include applicable taxes.

4.1.2. For bookings with accommodation, taxes are built into the price and aren't itemised on the invoice, in line with the tax regime that applies to travel agencies.

4.1.3. Once your booking is confirmed the price doesn't change. We don't apply revisions for changes in fuel costs, taxes or exchange rates.

4.2. What's included and what isn't

4.2.1. What each experience includes is set out on its product page and in your confirmation.

4.2.2. Unless stated otherwise, the following aren't included.

  • Travel to Lanzarote and transfers to and from the airport
  • Personal expenses, purchases and tips
  • Any service not expressly described

4.2.3. If you'd like help with any of these, write to us and we'll put together a quote.

4.3. Payment methods and schedule

4.3.1. You can pay by the methods available at checkout or by bank transfer.

4.3.2. For bookings with accommodation, the initial amount is applied to the total price and the balance is paid 90 days before the start date. We give you plenty of notice.

4.3.3. For all other experiences the total price is charged when we confirm your booking, unless the product page says otherwise.

4.3.4. If the balance hasn't reached us by the due date, we'll remind you and give you a reasonable margin. If we still don't receive it, we may cancel the booking applying the Cancellation & Refund Policy.

4.4. Additional services and quotes

4.4.1. You can add extra services by buying them on our website or asking us for a quote.

4.4.2. Every additional service is recorded in your booking and is governed by these terms and by any specific terms we give you when you book it.

4.5. Discounts and promotions

4.5.1. From time to time we run discounts, promotional codes and offers with a deadline.

4.5.2. Unless we expressly say otherwise when we announce them.

  • They can't be combined with each other or with other offers
  • They're subject to availability and to the deadline stated
  • They can't be exchanged for cash

4.5.3. Cancellation terms apply in the same way whether you booked with a discount or without one. No promotion limits the rights the law gives you.

4.6. Gift cards

4.6.1. You can buy a gift card for someone else to use on any of our experiences.

4.6.2. These are the terms.

  • Valid for twelve months from the date of purchase
  • Transferable, so whoever holds it can use it
  • Applied against the total price of the experience booked
  • If the price of the booking is higher than its value, the difference is paid by any other method
  • Not exchangeable for cash and not reloadable

4.6.3. Because it's transferable, we can't replace it if it's lost or used by someone else.


5. Requirements to take part

5.1. Documentation

5.1.1. Each participant is responsible for keeping their identity and travel documents in order.

5.1.2. We're not responsible for the consequences of not having valid documentation, including being unable to take part.

5.2. People under 18

5.2.1. Their participation requires authorisation from whoever holds parental responsibility or guardianship, and they must meet the minimum age stated on the product page.

5.2.2. Unless the product page says otherwise, they must take part accompanied by a responsible adult throughout the activity.

5.3. Physical condition

5.3.1. Some activities require a certain level of physical condition, which we state on the product page.

5.3.2. By booking you confirm that you're able to take part, or that you've told us about anything that may affect you under point 6.2.


6. What we need to know about you

6.1. Contact details

6.1.1. When you book you give us your contact details. Please make sure they're correct and up to date, as that's how we send you your documentation and practical information.

6.1.2. If you book for other people, we need their names and a contact for whoever is responsible for the group.

6.2. Health and dietary information

6.2.1. Before the experience we send you a form so you can tell us about any medical condition, allergy, treatment, dietary need or limitation that could affect your participation or your safety.

6.2.2. This is health data, which data protection law protects more strictly. We only process it with your explicit consent, solely to prepare and run the experience safely, and we delete it once it's no longer needed. The detail is in our Privacy Policy.

6.2.3. Please tell us as far in advance as you can. The sooner we know, the more room we have to adapt the experience.

6.2.4. If you don't give us this information, or what you give us is inaccurate, we can't adapt the activity and we can't be responsible for what follows from that.


7. Insurance

7.1. Our insurance

7.1.1. We hold public liability policies covering our activities.

7.1.2. On the product page for outdoor activities you'll find the information about the insurance covering them.

7.1.3. In addition, for bookings with accommodation your payments are covered by a guarantee against our insolvency. With your confirmation you receive the details of the guarantor, whom you can claim from directly if it were ever needed. This guarantee applies to bookings with accommodation and doesn't extend to other experiences.

7.2. Your travel insurance

7.2.1. We recommend taking out travel insurance covering, at least, cancellation costs, medical assistance and luggage.

7.2.2. Our policies cover our liability as a company. They don't cover you having to cancel for a personal reason, your medical expenses, or anything that happens on your journey to Lanzarote.

7.2.3. Cancellation insurance is the only way to recover the cost of your booking when the reason you're cancelling is a personal one.


8. How the activities run

8.1. Meeting point and timings

8.1.1. We give you the meeting point and start time with enough notice.

8.1.2. If you arrive late we'll do what we can to bring you in. That isn't always possible without affecting the group, and we can't extend the activity or repeat the part you've missed.

8.1.3. If you don't turn up and haven't told us, no refund applies.

8.1.4. If you leave before the activity ends, no refund applies for the part not taken, unless the reason is attributable to us.

8.2. Safety instructions

8.2.1. During the activity you must follow the instructions of the team leading it.

8.2.2. Where safety equipment is provided, you must use it as instructed.

8.3. What the team can decide

8.3.1. The person in charge can change the route, suspend the activity or interrupt it when weather conditions, the state of the ground or the safety of the group require it.

8.3.2. They can also ask a participant not to continue when their behaviour puts the safety or the running of the activity at risk. In that case no refund applies.

8.3.3. These decisions are always made on safety grounds and we explain them to you at the time.

8.4. The ordinary risks of being outdoors

8.4.1. Our outdoor activities take place in volcanic landscape, exposed to sun and wind and on uneven ground.

8.4.2. By signing up you accept the ordinary risks that come with this kind of activity and you agree to follow the safety guidance we give.

8.4.3. This acceptance doesn't limit our liability for failing to meet our obligations, nor any liability that can't legally be excluded, including personal injury caused by our negligence.

8.5. Looking after the environment

We run our activities only in places that are authorised for it or for which we hold the relevant permission, never in spaces where we don't have permits. We work in protected environments and in a Biosphere Reserve, and we're committed to preserving them by following the best practices available, both in Lanzarote and anywhere else we operate. We ask you to join us in that care and to respect the particular rules of each space, which we'll let you know about where relevant.

8.6. Materials

8.6.1. The materials we provide are for use during the activity.

8.6.2. Normal wear or breakage costs you nothing.

8.6.3. If materials are damaged or lost through clearly careless use, we'll ask you to cover the cost of replacing them.


9. Intellectual property and images

9.1. Your work

9.1.1. Whatever you create during our experiences is yours, with no conditions and nothing assigned to us.

9.2. Use of your image

9.2.1. During activities we take photographs and video.

9.2.2. To publish images in which you're identifiable we need your consent, which we ask for separately and which you can withdraw at any time by writing to us.

9.2.3. Not giving that consent, or withdrawing it later, doesn't affect your participation or the terms of your booking.

9.3. Our content

9.3.1. The content of our website and our materials belongs to us or to those who have licensed it to us, on the terms of our Legal Notice.


10. Cancellations and changes

10.1. If you cancel

10.1.1. You can cancel your booking at any time before the experience begins.

10.1.2. The applicable deadlines and terms are in our Cancellation & Refund Policy.

10.2. If we change or cancel

10.2.1. If we need to change anything you've booked, we tell you in writing and without delay, explaining the extent of the change and the options you have.

10.2.2. If we cancel or suspend for reasons not attributable to you, you can choose between a new date or a full refund of what you've paid, under our Cancellation & Refund Policy.

10.2.3. For bookings with accommodation, points 15.6 and 15.9 also apply.

10.3. Right of withdrawal

10.3.1. There is no fourteen-day right of withdrawal when booking our experiences at a distance.

10.3.2. Consumer law excludes it for leisure services provided on a specific date, and for package travel it reserves it to contracts signed away from business premises, which isn't our case.

10.3.3. This doesn't affect your cancellation rights, which are those in point 10.1.


11. Complaints

11.1. If something isn't running as booked, tell us at the time, without waiting until the experience is over. That's the best way for us to put it right while you're still with us.

11.2. You can do that by email, by WhatsApp, or by calling the contact number we give you before the start.

11.3. If you're still unhappy afterwards, write to us with your booking number and what happened. We'll reply within a maximum of ten working days.

11.4. We hold the official complaint forms of the Canary Islands. You'll find everything about how to make a complaint, including the electronic route with the Canary Islands Government, on our Contact Information page.


12. Data protection

12.1. The data controller is Brisa Digital SL.

12.2. Our Privacy Policy explains what data we collect and why, the legal basis for each processing activity, how long we keep it and how to exercise your rights.


13. Governing law and jurisdiction

13.1. These terms are governed by Spanish law.

13.2. If you're a consumer, you keep the protection given to you by the mandatory rules of the country where you habitually live, where those apply.


14. Changes to these terms

14.1. We may change these terms in the future.

14.2. Each booking is governed by the version in force when it was made, which is the one sent to you with your confirmation.


15. Additional terms for bookings with accommodation

This section applies only when accommodation forms part of what you've booked. In that case your booking is package travel and these rights come in addition to the sections above.

15.1. Information before you book

15.1.1. Before you're bound by the contract we make available to you the sheet setting out your key rights when you book a package, a document whose content is set by law and which explains what booking package travel means and what rights you have.

15.1.2. Together with the product page, that information covers what you need to know before booking.

15.2. Your contract

15.2.1. With your confirmation you receive the full content of what's been agreed, in a format you can keep and consult.

15.2.2. That document includes, alongside the detail of the services booked, any special requests we've accepted, the details of the body guaranteeing your payments, a contact to reach during your trip, and how to let us know about any problem.

15.3. Your payments are protected

15.3.1. The payments you make are guaranteed against our insolvency.

15.3.2. If for that reason a service were not provided, you can claim directly from the guarantor, whose details come with your confirmation.

15.4. Transferring your booking

15.4.1. You can transfer your booking to another person who meets the applicable conditions.

15.4.2. Let us know in writing at least 7 calendar days before the start date.

15.4.3. You and the person taking over are jointly responsible for the outstanding balance and for any costs the change generates, which we'll set out for you.

15.5. Price

15.5.1. Once your booking is confirmed the price doesn't change, as set out in point 4.1.3.

15.6. If we need to change something

15.6.1. If the change is minor, we tell you and the booking continues.

15.6.2. If we have to significantly change one of the main characteristics of what you booked, or we can't meet a special request we'd accepted, we tell you in writing without delay, with the effect on the price if there is one and a reasonable deadline for you to reply.

15.6.3. You can then accept the change, accept an alternative we offer you, or cancel with no penalty and recover everything you've paid.

15.6.4. If the change means a reduction in the quality or value of what you booked, you're entitled to a price reduction.

15.6.5. We don't cancel for lack of participants. If a trip doesn't reach the expected numbers, we propose an adapted version that keeps the accommodation, the meals, the transport and the artistic guidance. As with any significant change, the decision is yours.

15.7. If you cancel

15.7.1. You can cancel at any time before the start date, with the scale in our Cancellation & Refund Policy applying.

15.7.2. If you ask us, we'll set out in writing how the amount was calculated.

15.8. Unavoidable and extraordinary circumstances

15.8.1. If unavoidable and extraordinary circumstances occur at the destination or nearby which significantly affect the trip, or the carriage of passengers to the destination, you can cancel before the start with no penalty and with a full refund of what you've paid.

15.8.2. This right applies in every case, including if you booked with a discount or on a promotion.

15.8.3. It refers to objective circumstances outside both parties' control. Personal circumstances, such as illness, a missed flight or a change of plans, aren't covered and are governed by the cancellation scale. Cancellation insurance exists for those.

15.9. If we cancel

15.9.1. If unavoidable and extraordinary circumstances prevented us from running the trip, we'll tell you without delay and refund everything you've paid.

15.9.2. No additional compensation applies in that case.

15.10. Refund deadlines

15.10.1. Any refund under this section is paid without undue delay and in any case within a maximum of 14 calendar days from the termination of the contract.

15.10.2. It's made by the same method you paid with, and you don't have to claim it.

15.11. Our responsibility during the trip

15.11.1. We're responsible for every service included in your contract being provided as agreed, whether we provide it ourselves or another company does.

15.11.2. If a service isn't provided as agreed, we'll put it right, unless that's impossible or would involve disproportionate cost given the scale of the problem and the value of the services affected.

15.11.3. If we don't put it right, you're entitled to a price reduction for the period affected and, where appropriate, to compensation for the damage suffered, including non-material damage.

15.11.4. We're not responsible where the problem is attributable to you, where it's caused by someone unconnected to the services booked and is unforeseeable or unavoidable, or where it's due to unavoidable and extraordinary circumstances.

15.12. Telling us about problems

15.12.1. Please tell us without delay about any problem you notice during the trip, using the contact you receive with your confirmation.

15.12.2. The sooner we know, the more chance there is of solving it while you're still there.

15.13. Assistance

15.13.1. If you find yourself in difficulty during the trip we'll give you assistance without delay, providing information on health services, local authorities and consular assistance, helping you make contact and find alternative travel arrangements.

15.13.2. If the difficulty arose intentionally or through your own negligence, we may charge a reasonable fee for this assistance, which will never exceed our actual costs.
